Terms and Conditions of Use

GeekCrafts, a brand operated by Ana Sofia Martins e Silva Tapada, holder of NIF 204886210, located at Rua Domingos de Sequeira, 9 – Centro Comercial Girassol lj.21 – 2675-339 Odivelas, email address geekcraftsbyls@gmail.com and phone contact 938973030.

By using our 3D printing services and/or purchasing products through our online store, the Customer fully accepts the following terms and conditions:

1. Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

  • GeekCrafts: Ana Sofia Martins e Silva Tapada, NIF 204886210;
  • Customer: any individual or legal entity using the services or purchasing products from GeekCrafts;
  • Consumer: an individual acting for non-professional purposes, as per the Consumer Protection Law;
  • Services: 3D printing services provided by GeekCrafts;
  • Products: items sold through the online store.

2. Purpose

GeekCrafts is dedicated to:

  • Providing technical 3D printing services from files supplied by Customers;
  • Selling 3D products that are properly licensed or originally created.

GeekCrafts acts exclusively as a provider of technical services, not creating, altering, verifying, or validating the content, legality, or suitability of the files provided by Customers for printing.

3. Customer Responsibilities

3.1. Customer Warranties

The Customer declares and guarantees that:

  • They own or have all necessary authorizations, licenses, and rights to use and reproduce the files sent for printing;
  • The files do not infringe copyright, related rights, industrial property (trademarks, patents, designs or models), or any other third-party intellectual property rights;
  • The files do not contain illegal, defamatory, pornographic, racist, xenophobic content, or content that violates public order and good customs;
  • They have the legal capacity to contract or, if a minor, act with the express authorization of their legal representative.

3.2. Liability for Rights Violation

Any violation of third-party rights is the sole responsibility of the Customer.

The Customer agrees to indemnify and hold GeekCrafts harmless from any claim, legal or extrajudicial proceeding, liability, costs (including attorney fees), or damages arising from:

  • The violation of intellectual property rights or other third-party rights;
  • The illegality of the content of the files provided;
  • The misuse of the products or services acquired.

4. Right of Refusal

GeekCrafts reserves the right to refuse, without justification, any printing request or order that:

  • May infringe third-party rights;
  • Has an illegal nature or is contrary to public order;
  • Violates the company’s internal policies;
  • Does not meet the necessary technical requirements for printing.

The refusal does not entitle the Customer to any compensation or indemnity, without prejudice to the refund of amounts already paid.

5. Prices and Payment

5.1. Prices

All prices are presented in euros (€) and include VAT at the legal rate in force, unless expressly stated otherwise.

GeekCrafts reserves the right to change prices at any time, with the prices in effect at the time of order confirmation applying to Customers.

5.2. Payment Methods

Payments can be made via bank transfer, MBWay, PayPal, and credit card.

Products will only be shipped or delivered after payment confirmation.

6. Orders and Delivery Times

6.1. Confirmation

Upon receiving the order, GeekCrafts will send a confirmation email containing the order details.

6.2. Delivery Times

The indicated delivery times are merely estimates. GeekCrafts will make every effort to meet the agreed deadlines but is not responsible for delays caused by:

  • Carriers;
  • Force majeure or unforeseen circumstances;
  • Strikes or disruptions in postal services;
  • Technical issues with the files provided by the Customer.

6.3. Shipping Costs

Shipping costs are calculated based on weight, volume, and destination, and communicated to the Customer before finalizing the order.

6.4. In-store Pickup

Customers can choose to pick up orders directly at the physical store, located at Rua Domingos de Sequeira, 9 – Centro Comercial Girassol lj.21 – 2675-339 Odivelas, by prior appointment.

7. Right of Withdrawal (Consumers)

7.1. Period

In accordance with Decree-Law No. 24/2014, of February 14, the Consumer has the right to withdraw from the contract, without giving any reason, within 14 days from:

  • The date of receipt of the products;
  • The conclusion of the contract, in the case of service provision.

7.2. Exercising the Right

To exercise the right of withdrawal, the Consumer must notify GeekCrafts through:

  • Registered letter to: Rua Domingos de Sequeira, 9 – Centro Comercial Girassol lj.21 – 2675-339 Odivelas

The Consumer can use the withdrawal form available on the website or make an unequivocal statement of their intention to withdraw from the contract.

7.3. Exceptions

The right of withdrawal does not apply to:

  • Products made to the Consumer’s specifications or clearly personalized (as per Article 16, paragraph c) of Decree-Law No. 24/2014);
  • Digital files provided by the Customer for printing;
  • Products whose packaging has been opened or damaged by the Consumer, where packaging protection is essential;
  • Services fully executed with the Consumer’s prior express consent and acknowledgment that they lose the right of withdrawal.

7.4. Return and Refund

Products must be returned within 14 days after the withdrawal notification, in the condition they were received, accompanied by the respective invoice or proof of purchase.

  • In-person delivery at the physical store (by prior appointment)

Direct return costs are the responsibility of the Consumer.

The refund will be made within 14 days after receiving the products or proof of shipment, using the same payment method used for the purchase, unless otherwise agreed.

GeekCrafts may withhold the refund until receiving the products or until the Consumer provides proof of shipment.

8. Warranties

8.1. Legal Warranty

The products sold benefit from the 2-year legal warranty provided for in Decree-Law No. 67/2003, of April 8 (Warranty on the Sale of Consumer Goods).

The Consumer must notify GeekCrafts of the lack of conformity within 2 months from the date it was detected.

8.2. Manufacturing Defects

Products with manufacturing defects attributable to GeekCrafts can be repaired, replaced, or refunded, as applicable and in accordance with current legislation.

The Consumer has the right to choose between repair or replacement, unless the option is impossible or disproportionate.

8.3. Exclusions

The warranty does not cover:

  • Defects resulting from the quality, format, or inadequate technical characteristics of the file provided by the Customer;
  • Damage caused by improper, negligent, or non-compliant use of the product;
  • Normal wear and tear from use;
  • Personalized products that meet the specifications requested by the Customer;
  • Damage caused after delivery by accident, misuse, or alteration of the product by the Customer.

9. Limitation of Liability

9.1. General Limit

GeekCrafts’ liability, under any circumstances, is limited to the amount actually paid by the Customer for the service or product in question, without prejudice to legally non-waivable liabilities.

9.2. Exclusions

GeekCrafts is not responsible for:

  • Indirect, incidental, consequential, punitive damages, or lost profits;
  • Improper, illegal, or non-compliant use of products or services by the Customer or third parties;
  • Defects, imperfections, or impossibility of printing resulting from files provided by the Customer (corrupted, incomplete, technically inadequate);
  • Temporary interruptions of the website or services for maintenance or technical reasons;
  • Viruses or other harmful elements introduced by third parties into computer systems;
  • Loss or misplacement of orders after delivery to the carrier, without prejudice to the Customer’s right to claim from the carrier.

10. Intellectual Property

All content on the GeekCrafts website (texts, images, logos, graphics, design) is owned by GeekCrafts or used under license, and is protected by Portuguese and international intellectual property laws.

Reproduction, distribution, public communication, or transformation of the content without prior written authorization is prohibited.

11. Personal Data Protection

11.1. Data Controller

11.2. Purpose and Legal Basis

  • Communication with Customers (contract execution);
  • Compliance with legal obligations (accounting and tax);
  • Sending commercial information (with prior and revocable consent at any time).

11.3. Data Collected

  • Email address
  • Phone number
  • NIF (when requested)
  • Payment information (processed by secure third parties)

11.4. Data Subject Rights

Under the General Data Protection Regulation (GDPR – Regulation EU 2016/679), the Customer has the right to:

  • Access their personal data;
  • Rectify inaccurate or incomplete data;
  • Erase data (“right to be forgotten”), under legally provided conditions;
  • Restrict or object to processing;
  • Data portability;
  • Withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal);
  • File a complaint with the National Data Protection Commission (CNPD) – www.cnpd.pt.

11.5. Retention

Personal data will be retained for the period necessary to fulfill the purposes for which it was collected or as required by law:

  • Accounting and tax data: 10 years (IRC and VAT Code);
  • Commercial communication data: until consent is revoked;
  • Other data: 5 years after the last interaction.

11.6. Data Sharing

Personal data will not be shared with third parties, except:

  • Essential service providers (carriers, payment entities);
  • Competent authorities, when legally required.

All service providers are carefully selected and required to ensure data security.

11.7. Security

GeekCrafts implements appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or destruction.

12. Alternative Dispute Resolution

12.1. Complaints

In case of a dispute, the Customer should address their complaint in writing to:

GeekCrafts commits to responding within a maximum of 30 days.

12.2. Alternative Dispute Resolution Entities

In accordance with Law No. 144/2015, of September 8, the Consumer can resort to the following Alternative Dispute Resolution (ADR) entities:

13. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Portuguese law, namely:

  • Civil Code
  • Consumer Code
  • Decree-Law No. 24/2014, of February 14 (Distance Contracts)
  • Decree-Law No. 67/2003, of April 8 (Warranty on the Sale of Consumer Goods)
  • Regulation (EU) 2016/679 (GDPR)
  • Law No. 144/2015, of September 8 (Alternative Dispute Resolution)

In case of dispute, the competent court will be:

  • The court of the district of Lisbon (GeekCrafts’ headquarters); or
  • In the case of a Consumer, the court of their habitual residence, as provided by law.

14. Changes to the Terms

GeekCrafts reserves the right to change these Terms and Conditions at any time, by publishing the updated version on the website.

The changes will take effect immediately upon publication and apply only to orders placed after that date.

Orders already confirmed will remain subject to the terms in effect at the time they were placed.

The Customer should regularly check this page to stay informed about any changes.

15. Final Provisions

15.1. Partial Invalidity

If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions will retain their full validity and effectiveness.

15.2. Communications

All communications between GeekCrafts and the Customer must be made in writing through:

15.3. Language

These Terms and Conditions are written in Portuguese, which will prevail in case of doubt or conflict of interpretation.

17. Acceptance

By submitting a file for printing, completing a purchase in the online store, or making an in-person purchase, the Customer expressly declares that:

  • They have read and fully understood these Terms and Conditions;
  • They agree to be bound by them without reservations;
  • They have the legal capacity to contract or, if a minor, act with the express authorization of their legal representative;
  • They acknowledge that the use of services and the purchase of products are subject to these Terms.

Not accepting these Terms and Conditions prevents the use of GeekCrafts services and the purchase of products.
